Asimismo, manifestó que, al margen de ello, con respecto a la ruptura de acta, hay cinco personas que no firman el acta, entre ellos él, el único que firmó fue el doctor Benji Espinoza; al oír eso, el periodista le preguntó porque no firmó el acta.
Por eso, el abogado le dijo que no lo hizo porque se había roto el acta, no se puso lo que se había consignado y no quería consignarse, quien inició el operativo fue Harvey Colchado, el mismo que no tenía según mandato judicial.
En esa línea, puntualizó que el coronel no pertenece a la policía del Ministerio Público ni a la del Poder Judicial, sino que pertenece a otra institución y debía tener su papeleta conjuntamente con todo su personal firmada por su jefe inmediato superior que lo autorizaba a salir y eso no lo tenía, como tampoco tenía uniforme.
Finalmente, Eduardo Pachas indicó que han puesto en conocimiento al inspector federal para que de acuerdo a sus atribuciones realice las investigaciones, defina que es lo que Harvey Colchado podía hacer y que no, para que lo resuelvan.
